France split by debate on parenthood as president moves to legalize gay marriage

PARIS - The French are all for sex and all for family ? so long as you're having sex to create one. Anything dealing with assisted reproduction makes a sizable portion of them uncomfortable, as the president's plans to legalize gay marriage have unexpectedly exposed.

The debate over whether society and science are overreaching when it comes to parenthood has sent thousands into the streets, turned the bridges over the Seine into billboards and prompted charges that women's bodies will soon be for rent in a society that still has surprisingly deep conservative roots.

President Francois Hollande's promise to legalize gay marriage was seen as relatively uncontroversial when it first came up as a campaign pledge. Then, as the debate began this week, his justice minister quietly issued an order to grant French birth certificates for children born to surrogates abroad.

The news reopened a raw and unwelcome national debate on fertility treatments, surrogacy and adoption. Assisted reproduction is off-limits to all but heterosexual couples showing at least two years of companionship. Egg donation has been regulated nearly into non-existence, and surrogacy of any kind is punishable by a prison term.

Infuriated opponents pounced, accusing the Socialist government of underhanded tactics to transform families. Despite France's liberal attitudes and Socialist government, the country also has strong Roman Catholic influence and prides itself on its strong support for traditional families.

Justice Minister Christiane Taubira went before a raucous parliamentary session Wednesday to defend her order, half the lawmakers giving her an ovation and another sizeable group trying to jeer her into silence.

"You're encouraging methods that are illegal in our country, that are an attack on human dignity," Jean-Francois Cope, the opposition leader, accused her on Wednesday. "Children become objects, objects that can be bought and sold."

Taubira said the order was only a reflection of current citizenship law, not a new regulation that would lead to legalized surrogacy within France. "It affirms French nationality, it doesn't grant it," she said, insisting that no one ? from the president on down ? wanted French surrogate mothers.

Facing unexpected opposition to their once-popular plans to legalize gay marriage, Hollande's Socialists in early January dropped plans to link the measure to relaxed restrictions on fertility treatments. And Taubira on Wednesday reiterated earlier denials of any plan to legalize surrogacy.

About 200 egg-donor babies and about 1,000 sperm-donor babies are born annually to French people according to official government figures, with thousands of couples waiting for years for a chance to try.

In France, egg donors must already have children of their own and are not allowed reimbursement for many of the expenses related to the donation ? including travel and childcare. Sperm donors face similar restrictions, including showing proof of prior fatherhood. In 2010, 299 men donated sperm in France.

Surrogacy is widely reviled, even among those who want to open access to fertility treatments.

The tight restrictions have sent many French abroad ? single women and men, and gay and straight couples who fear their time is running out. Many go to Belgium or Spain. Fearing social stigma, few talk about it when they return home pregnant.

Hundreds of thousands of protesters on both sides have swamped the streets of Paris. This week, as the parliamentary debate began, opponents of gay marriage and changes to the law governing fertility treatment strung banners over the bridges that cross the Seine, including one that read "Everyone is born from a man and a woman."

Hollande had clearly hoped to put off a national debate on assisted reproduction: "Had I been in favour, I would have included it in the proposed law," he said in December as renegade lawmakers from his Socialist Party tried to take up the issue.

The president has let Taubira do most of the talking ? and take most of the heat. It's her name that is linked to the tensions that have been growing in France as both sides line up allies.

For those who support easier access to assisted reproduction, the link to gay marriage was inevitable ? especially in a country where the word "equality" is enshrined in the national motto.

"As soon as you start discussing same-sex marriage, then you know this is going to come up," said Guido Pennings, a professor of bioethics at Belgium's Ghent University who conducted a 2010 survey on what he described as "reproductive tourism" in Europe.

Pennings said women from Italy, France, Germany and Norway ? all relatively restrictive countries when it comes to fertility treatments ? were most likely to cite "legal reasons" for going abroad. Four in 10 of the French women who responded to the survey described themselves as gay or bisexual.

He said governments should be asking themselves: "Do I treat my own citizens correctly when I force them to go elsewhere?"

Isabelle Chandler, spokeswoman for the French infertility group MAIA, said French women are being driven away by the strict criteria and a lack of financial support. Chandler, who like many French draws the line at surrogacy, said her organization is willing to advise any woman who wants fertility treatment, whether or not she's in a relationship.

For both men and women donors, anonymity is strictly required ? another aspect of fertility treatment that sends French couples abroad, according to some activists.

"Lawmakers think about couples, they think about donors, but they don't think about children," said Audrey Gavin, a lawyer who is president of an organization that advocates for non-anonymous donation. She hoped that the debate on gay marriage might open minds to reconsider France's entire approach to fertility treatment.

Olivier Dussopt, a Socialist lawmaker who was among the group to first attempt to relax the laws governing fertility treatments, said he thinks France will come around to his way of thinking for assisted reproduction, although he said surrogacy remained completely off the table "for both the right and the left."

Dussopt compared the current debate to the bitter period leading up to the decision to legalize abortion in 1975. Now, he said, abortion is essentially a non-issue in France.

"There's a form of social conservatism even in a liberal society," he said. "When it's a social question, France can seem split in two. Once it's resolved, it goes just fine."

Child with cancer plans charity fundraising night

AN 11-YEAR-OLD girl facing a third bone marrow transplant is taking time out to organise a fundraising night for four charities.

Bishop Wand schoolgirl Sophie Ryan-Palmer has been through an agonising 10-year journey but remains hopeful and is always seen sporting a smile.

The former Chennestone Primary School pupil was first diagnosed with acute lymphoblastic leukaemia (ALL) ? a blood cancer ? in 2003, aged two, and is now preparing to go back into the operating theatre and undergo a new clinical trial.

Her proud mother, Debbie Ryan, along with Sophie?s friends, Rachel Luke and Tiffany Jones, are helping the youngster hold a fundraising night for four charities close to her heart.

She is calling on the community to help by donating raffle prizes and on the night Sophie will have her hair shaved off in a bid to drum up as much support as possible for Children with Cancer, Anthony Nolan Trust, Rays of Sunshine and Charley Paige Trust.

Ms Ryan said: ?We are desperate for some raffle prizes and would like to raise as much money as possible for these charities so dear to Sophie?s heart.

?To get her hair shaved off for them is unbelievable as she has lost her hair so many times, which has not been easy for her, so to do this is a major thing and shows you what an inspirational child she is.

?I am so proud of her, knowing what a battle she has ahead of her and whatever I can do to help with the fundraising I will do.?

Sophie, of Rochester Avenue, Feltham, received the ?all clear? in March 2006 but the family?s happiness was short-lived when the cancer came back just before her sixth birthday.

Another round of chemotherapy in 2007 followed and the cancer went into remission in 2009.

Two years later, in June 2011, the leukaemia came back once more and after more treatment Sophie had a bone marrow transplant and was discharged from Great Ormond Street Hospital in January last year.

Speaking about the turbulent times, Ms Ryan added: ?We went into hospital in December 2011 and went through a bone marrow transplant. It was rather tough, ending up in ICU but we got through it. We had lots of tears, pain and laughter on the way.?

Sophie has chosen to take part in a new clinical trial called CD19, which requires her to have another bone marrow transplant at the end of next month. Doctors hope that the pioneering treatment will target the cancer cells directly and kill them where conventional treatment has been unsuccessful.

Since the first surgery, Sophie has won an award from Spelthorne Borough Council for triumph over adversity, made a new start at Bishop Wand CofE school in Layton?s Lane, Sunbury, and welcomed a new member to the family ? Happy the dog.

Throughout her illness, she has lived by the motto ?happy, happy, happy, fun, fun, fun ? always smile?.

Sophie celebrates her 12th birthday on Monday February 11.

India gang rape accused to be formally charged on Saturday: lawyer

NEW DELHI (Reuters) - Five men accused of gang-raping and murdering a 23-year-old student in New Delhi in December will be formally charged in court on Saturday, setting the stage for the start of their trial, a defense lawyer said.

The case brought thousands of protesters onto the streets and ignited intense public debate over the failure of the police and the government to stem rampant violence against women in India.

A strictly enforced media blackout on the court proceedings means there will likely be few details about the trial, leaving many with unanswered questions about an attack that was shocking in its brutality.

The student was tortured with an iron rod and raped on a moving bus in the capital on December 16. She was then thrown bleeding onto the street along with a male friend who was also beaten. She died of organ failure in a Singapore hospital two weeks later.

Prosecutors say they have a large file of evidence, including DNA from blood-stained clothing recovered by police.

The five accused will plead not guilty to rape and murder, one of the defense lawyers said. Defense counsel have told Reuters they will argue that the DNA evidence was fabricated and at least two of the accused will say they made confessions after they were tortured in custody.

The five, who police say range in age from 19 to 34, have been appearing in court almost daily for pre-trial hearings on the framing of the charges. They arrived at court on Wednesday wearing scarves to conceal their faces.

Defense lawyer A.P. Singh, who represents two of the accused, said the court would begin formally charging the five men on Saturday. The prosecution wants the men tried for rape, kidnapping, murder and robbery, among other charges.

The court may not complete the process on Saturday and could continue on Monday, Singh said. The trial would begin immediately afterwards.

The trial will be conducted in a special fast-track court that was set up after the attack. The court is across the street from a cinema where the victim watched the movie "Life of Pi" before boarding the bus with her friend.

The proceedings will take place behind closed doors to protect the identity of the victim. The judge has also issued gag orders on defense lawyers and the media, warning them not to repeat anything said in court.

A sixth accused will be tried as a juvenile in a separate court, a special panel ruled this week after it accepted school records showing him to be 17 years old. If convicted the teenager would receive a maximum of three years in jail.

T RYING TO HAVE OUR CAKE & EAT IT TOO:?WHY COMPULSORY SCHOOL ATTENDANCE IS ANTITHETICAL TO EDUCATION; HOW ARBITRARY AUTHORITY AFFECTS INSTITUTIONAL BEHAVIORS & ENVIRONMENTS & WHY THOSE BEHAVIORS HAVEN?T BEEN PROPERLY STUDIED

(BRIEF TENTATIVE ANSWERS TO QUESTIONS POSED IN PART I.)

Compulsory Attendance laws ARE the Problem

1. The humiliating frame of reference a child has when attendance laws are in effect does indeed account for nearly everything that happens in school and the pathological derailing of the schooling process. These laws define the entire experience and transform it from one centered on the child and his pursuits to one centered elsewhere. Learning no longer originates with the child?s need to discover.

2. Laws of this magnitude and ubiquity are seldom challenged or evaded. When they are, the entire force of the state apparatus is at the disposal of the authorities, starting with teachers and truant officers and extending to the US Supreme Court. Authority is indistinct and primarily anonymous unless challenged directly. And, while references may be made reminding parents and children of their involuntary servitude, parents typically become the willing enforcers for the state, knowing the consequences of non-compliance. The implications and consequences seem endless and must be dealt with separately. Education becomes indoctrination and learning is measured and dis-integrated in an infinite regression and digression. The pernicious damage to children is universal and enduring.

3. The lack of autonomy for teachers when the state is the ultimate authority is a non-starter. Teachers are assigned a role that is midway between being law enforcement officers and slaves to petty and utterly useless rules and curriculum guidelines, regardless of philosophies and intentions. This is set in legal stone. The real impetus no longer has anything to do with education.

4. Virtually all relevant research over several generations has heavily reinforced the logical observation that learning that occurs under duress or in an environment that is hostile or oppressive is contaminated, corrupted and compromised. Such ?learning? fits a definition for indoctrination, memorization or dogma, rather than for education or useful instruction.

5. There is no cure for parental exclusion and dis-engagement. When the parental role is usurped and when the law fails to allow distinctions between parents or to respect their rights, they are placed in an impossible bind. Parental (non)participation becomes nothing more than a nice illusion and a critical talking point to justify school failure.

6. ?Time no longer belongs to the teacher in this scenario. The needs of students must take a back seat to fulfilling the official or bureaucratic duties and expectations imposed from all directions. Order, quiet and structure become disorder, noise and disorganization everywhere, due to competition, confusion and conflicts between institutional needs and those of students.

7. No credible definition for education allows for learning that is externally imposed. Education cannot be prepackaged by any stretch of the imagination. It is and must be about a process of answering one?s own questions for one?s own reasons through contemplation as a function of living, moving and breathing, and experiencing life primarily in a private or personal space.

8. There is a logical expectation that schools must provide a specific type and degree of academic service and that there will be documentation and proof that such services are provided. School laws do not exist to ensure mere babysitting. Therefore, content must be identified and defined (curriculum) with ?experts? appointed who are presumed to know what to include, what to exclude, and everything that ?properly? pertains to format and presentation. In the real world however, curriculum is a formula for disaster. It is a myth to think that any entity or group can prepare in advance a standard template or the optimal content of education for multiple individuals.

9. The absolute need for a top-heavy administrative hierarchy is in opposition to the constant cry for less waste of taxpayers? money. Managers must manage; they contribute little of value, and while they talk about change and goals, they stand directly in the way of any meaningful reform, due to their conflicting positions and interests.

10. Compulsory attendance is undemocratic. Children learn a profoundly skewed lesson about democracy from spending over a decade in systems that are inescapably authoritarian. Continual and incessant evaluation is the only way for schools to attempt to provide some kind of documentation ostensibly verifying that the deprivation of rights is appropriately compensated despite the fact that standards for schools have never been anywhere near satisfactory on any scale. When evaluations don?t show sufficient progress, fakery and all sorts of creative fudging become the order of the day.

Threats, coercion, browbeating, abuse, indoctrination, and the tactics of oppression come with this territory. Likewise, for the need for non-stop testing. Despite the dedicated efforts of certain staff or others, including parents, local and temporary efforts to neutralize or circumvent the authority and power of officials and bureaucratic requirements will always fail in many respects before they get a foothold. It has been ever thus.

Obama's gun plan begins slow, scrutinized trek through Congress

The Obama administration?s gun violence proposals are beginning their arduous path through Congress, as the opening act moves to the Senate Wednesday and?lawmakers begin to pick apart some of the plan?s most ambitious gun control measures.

Majority Leader Harry Reid, D-Nev., on?Tuesday vowed?to bring up some version of President Barack Obama?s comprehensive gun violence proposal for a vote on the Senate floor when it is ready. But he said Republicans would also be free to offer amendments to the bill, which could lengthen the legislative process and strip stricter gun control measures of their teeth.

?It's very clear that there's going to be a bill brought out of the committee, brought to the Senate floor, and there will be an amendment process there, the people bringing up whatever amendments they want that deals with this issue,? Reid told reporters Tuesday on Capitol Hill.

The Nevada Democrat?s comments come as Congress begins the challenging process toward approving its first major piece of gun legislation since the 1990s.

The Senate Judiciary Committee holds its first hearings that topic on Wednesday, featuring high-profile witnesses on either side of that issue. Speaking in favor of gun control will be retired astronaut Mark Kelly, the husband of Gabrielle Giffords, the former Arizona congresswoman injured critically in a 2011 shooting.

On the other side will be National Rifle?Association CEO?Wayne LaPierre, whose influential gun rights lobby is working to thwart the administration?s proposals on Capitol Hill. According to LaPierre?s prepared testimony, released Tuesday by the NRA, he will stake out a clear stance against the heart of the president's plan.

?When it comes to the issue of background checks, let?s be honest ? background checks will never be ?universal? ? because criminals will never submit to them,? said LaPierre in those prepared remarks.

LaPierre's testimony on Wednesday will surely reflect the sharp opposition to the Obama plan among gun rights groups; aversion that threatens to transform the battle into a legislative slog and sap the administration?s momentum.

Skepticism over assault weapons ban
While the outrage prompted by the December rampage at Sandy Hook elementary school has lingered longer than previous mass shootings, the impetus for gun control measures threatens to fade as time passes.

Already, one of the central proposals from Obama?s plan ? renewing the ban on assault weapons ? faces an uphill battle to be included in any final legislation.?

The New Republic's Chris Hughes and Frank Foer join Morning Joe to discuss the publication's relaunch which features a wide-ranging interview with President Barack Obama.

Reid, who has said he would not seek Senate passage of legislation that had no chance of approval in the House, was non-committal on the issue of the assault weapons ban during his comments on Tuesday.?

?I'll take a look at that,? he said of a proposed ban on assault weapons favored by California Democratic Sen. Dianne Feinstein.

?As I've indicated to you folks, we're going to have votes on all kinds of issues dealing with guns. And I think everyone will be well advised to read the legislation before they determine how they're going to vote for it.?

Speaker John Boehner, R-Ohio, has said that the House would consider whatever legislation on guns the Senate manages to pass, but has committed to little more than that.?

And, in fact, whatever legislation the Republican-controlled House is able to consider might depend ultimately on a handful of moderate Senate Democrats.

Several of those lawmakers have expressed skepticism toward the assault weapons ban, but have conveyed more interest in universal background checks ? the element of Obama?s plan that gun control proponents that might have a better chance at passage.?

That provision appears poised even to win some Republican support: Oklahoma Republican Sen. Tom Coburn told a Tulsa television station on Friday that he?s working with Democrats on legislation to ensure universal background checks.?

Senate Minority Leader Mitch McConnell, R-Ky., was more reluctant to endorse such a measure, saying during an availability at the Capitol on Tuesday: ?I'm among those who'd be happy to take a look at whatever the majority decides to advance on that subject.??

But Paul Ryan, the Wisconsin congressman who frequently mentioned his pride as a hunter during his time as Mitt Romney?s running mate appeared to lend support to that idea during a Sunday interview on ?Meet the Press.??

?I think the question of whether or not a criminal is getting a gun is a question we need to look at. That's what the background check issue's all about,? he said. ?And I think we need to look into making sure that there aren't big loopholes where a person can illegally purchase a firearm.?

Cyprus reprints election ballots in Guinness flap

NICOSIA, Cyprus (AP) ? Cyprus has been forced to reprint all 575,000 ballot slips for next month's presidential election after Guinness World Records objected to a candidate's use of its logo.

Deputy Chief Returning Officer Demetris Demetriou told state-run Cyprus News Agency on Wednesday that the government will ask Andreas Efstratiou to fork out at least ?15,000 ($20,000) to cover reprinting costs.

Demetriou said Guinness had initially permitted Efstratiou to use the logo in his first presidential run in 2008. Efstratiou, who runs a bridalwear shop, earned a Guinness Book of World Records entry for creating the longest wedding gown train (1,362 meters (4,468 feet) in 2007.

But Guinness told Efstratiou to stop using the logo in 2011 and complained to Cypriot authorities when it recently found out that he had used it again.

The real cost of immigration ?reform? ? our ... - Legal Insurrection

Rather than enforcing our current laws, and for purposes of political expediency, we are moving toward?another vast expansion of federal government monitoring and information collection.

Look at what we are going to have to do in order to not hold people who came here illegally accountable for their unlawful actions (from the Framework announced today).? Some of these things are not new, just ?improved? variations of monitoring the population, including more rigorous checks not only of who enters, but who exits, and also who is working where.? At least no one is yet proposing exit visas in addition to entry visas.

Remember, in order to collect information on illegals, the government needs also to collect information on legals.? This all may be ?necessary,? but at least recognize what illegal immigration and its ?reform??is costing us in terms of our personal privacy.

Increasingly we are becoming a nation monitored and watched at every level and in every place,?from the mountains, to the prairies, to the oceans, white with foam:

Additionally, our legislation will increase the number of unmanned aerial vehicles and?surveillance equipment, improve radio interoperability and increase the number of agents at?and between ports of entry. The purpose is to substantially lower the number of successful?illegal border crossings while continuing to facilitate commerce.

Our legislation will require the completion of an entry-exit system that tracks whether all?persons entering the United States on temporary visas via airports and seaports have left the?country as required by law.

Deal signed to clear Myanmar debt, allow new loans

YANGON, Myanmar (AP) -- The World Bank on Sunday announced a long-awaited deal to allow Myanmar to clear part of its huge decades-old foreign debt, opening the door for new much-needed lending to jump-start its lagging economy.

The bank's Washington headquarters announced in a statement that the Japan Bank for International Cooperation, the country's overseas development bank, will provide a bridge loan to Myanmar to allow it to cover outstanding debt to the World Bank and the Asian Development Bank, which totals about $900 million.

Myanmar stopped payments on its old loans about 1987, making it ineligible for new development lending.

The deal is a major breakthrough for Myanmar, with loans likely to go to upgrading its dilapidated infrastructure, including electricity and ports. The knock-on effect would be to bring in more foreign direct investment, already attracted by the country's relatively low-cost economy.

The deal is also likely to draw criticism, because it comes as Myanmar's army is pushing hard against ethnic Kachin rebels in the country's north, in an echo of the notorious counterinsurgency campaigns of previous military regimes.

A former general, Thein Sein, became the country's elected president in 2011 and began reversing almost five decades of military repression by instituting political and economic reforms.

He won the substantial easing of economic and political sanctions imposed against the junta by the United States and other nations. But some pro-democracy activists say his administration has been rewarded too much, too fast, allowing some abuses to continue, such as repression of ethnic minorities.

The World Bank had already made some exceptions to providing new aid.

In November, it approved an $80 million project to provide $25,000 grants to villages in 15 townships across the country, where community councils will identify the kind of help they want, such as roads, bridges, irrigation systems, schools, health clinics or rural markets. The bank reopened its office in Myanmar in August last year.

The bank was able to act because President Barack Obama earlier lifted a long-standing U.S. restriction on international financial institutions, such as the World Bank, lending to Myanmar after Congress passed legislation enabling that step. It was one in a series of steps by Washington to reward the Southeast Asian country for its democratic reforms.

The World Bank statement did not detail the mechanics of the new deal to clear the debt arrears.

It did say the bank's board on Jan. 22 approved a $440 million "Reengagement and Reform Support Credit to Myanmar."

It said the credit would support "critical reforms being implemented by the Government to strengthen macroeconomic stability, improve public financial management and improve the investment climate."

It added that its proceeds would "also help the Government meet its foreign exchange needs, including repaying (the) bridge loan" and that there are currently discussions with the government to identify priority needs.

Separately, the Manila-based Asian Development Bank announced it would extend a $512 million loan to Myanmar under the same sort of arrangement with the Japan Bank for International Cooperation ,

"Myanmar has come a long way in its economic transformation, undertaking unprecedented reforms to improve people's lives, especially the poor and vulnerable," the statement quoted the World Bank's Myanmar Country Director Annette Dixon as saying.

"Much work remains to be done. We are committed to helping the government accelerate poverty reduction and build shared prosperity. The Bank's engagement, together with the ADB, the Government of Japan and other partners, will help attract investment, spur growth and create jobs."

Myanmar had run up $8.4 billion in debt during the socialist regime of the late Gen. Ne Win between 1962 and 1988, and $2.61 billion of debt after a new military junta took over in 1988, making for a total of just more than $11 billion.

The largest creditor before 1988 was Japan, with loans of $6.39 billion, and the biggest post-1988 creditor was China, with $2.13 billion.

Ice storm descends on Midwest before heading east

Hundreds of flights were canceled as an ice storm brought freezing rain to the Midwest before making its way toward the northeast. The Weather Channel's Mike Seidel reports.

A storm encased the Midwest in glistening ice on Sunday, forcing officials to cancel flights and closing roadways and threatening to tangle the start of the work week as freezing rains headed east.?

Hundreds of churches across Iowa called off Sunday services as sidewalks were turned to sheets of ice by the storm that meteorologists said had covered the Midwest in about a half-inch of ice by midday.?

Flights in and out of Chicago, Minneapolis and St. Louis were grounded on icy runways.?


The National Weather Service issued a freezing rain advisory for Chicago and the surrounding area for Sunday until 9 p.m. local time, when temperatures were expected to warm up enough to make it just rain. Until then, the weather service warned of dangerous conditions for driving and even walking.?

"Pockets of sleet, freezing rain and freezing drizzle are possible farther east late tonight into Monday morning from Buffalo, New York, to New York City, Philadelphia, Washington, D.C., and Roanoke, Virginia," meteorologist Brian Edwards said on Accuweather.com.?

Slick roadways were reported from South Sioux City, Nebraska, to Iowa, where numerous crashes were reported, according to the Iowa Department of Transportation. In Franklin County, Iowa, Interstate 35 was blocked by tractor trailers struggling to get a grip on treacherous surfaces.?

"Instant icing of windshields and roadway surfaces (as well as driveways, sidewalks and parking lots) can be expected in the areas with freezing temperatures," the Iowa DOT said.?

In Missouri, ramps to connecting Interstate 270, which circles the St. Louis area, to Interstate 70 were closed early Sunday morning because of ice, but were later reopened, said Marie Elliott, a spokeswoman for the Missouri Department of Transportation.?

The landscape of the music industry continued to shift this past week as labels and film studios announced efforts to rescue the bankrupt retailer HMV, and Kim Dotcom launched his controversial cloud sharing service. Also, the co-founder of the online music platform DIGIHUBB examined some of the ways artists are using social media well.

The Music Industry Will Fight to Save HMV

?

Music labels and film studios will most likely support an organized rescue plan for the recently bankrupt music retailer HMV. Major music companies such as Universal Music, Warner Music and Sony will reportedly extend very lenient credit terms to potential buyers and offer discounted CD and DVD prices to make HMV look desirable, reported The Sunday Times. And Universal, especially wants to see the company survive:? It acquired liability for rent for 16 HMV stores when it absorbed EMI in 2012.

HMV has been in existence for 92 years and is the last existing retail chain that specializes only in music and entertainment. Many, especially those holding onto the old world order of the music business are terrified of the pressure its fall will put on the industry. They feel that brick-and-mortar supermarkets and online companies like Amazon will compete even more aggressively by cutting their prices dramatically.

At the same time, 760 staff members at DVD and games rental firm Blockbuster in Britain lost their jobs as Deloitte announced it would be closing 129 of the 528 stores in Britain within the next few weeks. Both this event and the collapse of HMV hit the retail sector of the UK hard.

Hilco, the owner of HMV Canada is one of the top buyers for HMV in the UK and reportedly began talks with administrators Deloitte on January 18. However, there are also another 50 possible buyers looking into the purchase of HMV. And CEO Trevor Moore stated he is ?convinced? that the company can be saved because of all the interest. Other bids could potentially come from Game, the private equity firm Endless and private equity veteran Jon Moulton/Better Capital. Hilco has already been successful at improving sales at HMV Canada since he bought it in 2011.

Kim Dotcom to Cause More Piracy Controversy with Mega

?

Notorious Internet entrepreneur Kim Dotcom launched his new online music and film locker service Mega on January 21, even though he and three of his colleagues are still waiting to be extradited from New Zealand to the U.S. And the site?s traffic so far has showed he is still a formidable force online, according to an article in The Huffington Post. His controversial service has once again opened up concerns for many in the music industry surrounding piracy issues.

?

Mega hit one million registered members within 24 hours of its launch. The extreme traffic actually shut down servers several times as the site climbed quickly to the top website in New Zealand and the 141st most-visited site in the world as of last Sunday. The site presents new users with 50 GB of free cloud storage and has already hit higher daily visits than popular sharing services Dropbox and Rapidshare.

?

Dotcom?s renowned file-sharing service Megaupload was shut down by the FBI in January of last year, and he was brought up on copyright and racketeering charges. The entrepreneur announced that the new site is totally legal because of encryptions that will make accessing its files difficult. He told Reuters, ?This is not some kind of finger to the U.S. government or to Hollywood ? Legally, there?s just nothing there that could be used to shut us down. This site is just as legitimate and has the right to exist as Dropbox, Boxnet and other competitors.?

Jack Schofeld of ZDNet pointed out that the FBI has been integral in turning Dotcom into an ?Internet folk hero;? its high-profile investigation surrounding the shutdown of Megaupload gave him an ?endless supply of free publicity.?

?

Despite Mega?s strong beginning, its success will still be dependent on Dotcom?s future. However, Dotcom?s extradition is now not likely to occur because of major blunders made by New Zealand law enforcement and the spy agency GCSB when Dotcom was first arrested.

?

And the new site?s legality is still up for debate, despite its creator?s insistence that it is legitimate and its tagline ?the privacy company.? Jonathan Bailey of Plagiarism Today said that committing acts of piracy using the service is inhibited by client-side encryption, which forces downloaders to need a link and an encryption key to get at files from the uploader. However, experts have already pointed out some potential problems with security and safety. Dan Goodin of Ars Technica said that Steve ?Sc00bz? Thomas has already created a product that can pull passwords from Mega?s encrypted confirmation emails. ?

Mega has already acknowledged this bug and promised password changes in the near future.

Maximizing the Power of Social Media

DIGIHUBB co-founder Tom Fazakerley shared some insights about how mega-artists like Katy Perry, Jessie J and Common are successfully marketing through social media and how artists of all shapes and sizes can follow their examples in The Guardian last week. He also talked about which platforms are working particularly well.

As he pointed out, MySpace and to an even greater degree, YouTube have enabled artists to throw their music out to a massive audience and removed boundaries within the music industry. And continuing technological shifts within the business along with the constant release of new platforms and apps are helping to make ?getting heard? easier for artists, producers and promoters and have been responsible for the careers of people like Justin Bieber. ??

Fazakerly offered up some tips for those that want to harness the power of social networking:

  • ?Understand the mainstream music industry and read into what?s popular. Follow trends but make them your own; that differentiation is what separates the special few from the crowd.?
  • He also suggested that bloggers and vloggers need to really highlight their personalities:? ?For example, you could start a tour video diary or use a vlog to show your life outside music ? Separate your personal recordings from your professional ones by creating an account for each.?
  • He also noted that Twitter is key, because it keeps things short and is very easily digested by fans and potential fans:? ?Treat Twitter as if it were an online networking event; respond to as many people as you can with a personal message, engage with your fans, regularly retweet and generally build relationships.?
  • As he noted, Facebook is still the top social network as well as the #1 photo-sharing place on the Web, so it represents a critical visibility point:? ?Create an artist or band page to keep your work and personal life a little separate ? It?s about building a relationship with your fans and enabling as many people to discover your music.?

Above all, he advised that artists actually have to be social on social media and check out the work of other musicians, comment and offer up helpful advice and support when appropriate. All the most successful artists on social media platforms engage in this way.

Fazakerley concluded, ?You need to show you are innovative and understand the growing market and latest developments; only then can you let your talent and music production fly.?

Truth and beauty in chemistry

The mathematician Hermann Weyl who made many diverse contributions to his discipline once made the startling assertion that whenever he had to choose between truth and beauty in his works, he usually chose beauty. Weyl was working at the Institute for Advanced Study in Princeton whose seal embodies both beauty and truth. Mathematicians and theoretical physicists are especially attuned to the notion of beauty. They certainly have history on their side; some of the greatest equations of physics and theories of mathematics sparkle with economy, elegance and surprising universality, qualities which make them beautiful. Like Weyl, Paul Dirac was famously known to extol beauty in his creations and once said that there is no place in the world for ugly mathematics; the equation named after him is a testament to his faith in the harmony of the universe.

How do you define and reconcile truth and beauty in chemistry? And is chemical truth chemical beauty? In chemistry the situation is trickier since chemistry much more than physics is an experimental science based on models rather than universal overarching theories. Chemists more than physicists revel in the details of their subject; in the physicist Freeman Dyson?s dictionary, chemists would be frogs rather than birds. Perhaps the succinct equations of thermodynamics come closest in chemistry to defining beauty, but physics can equally lay claim to these equations. Is there a quintessentially chemical notion of beauty and how does it relate to any definition of truth? Keats famously said, ?Beauty is truth, truth beauty?. Is this true in chemistry?

At this point it?s fruitful to compare any description of beauty in chemistry with that in science in general. Although scientific beauty can be notoriously subjective, many explanatory scientific frameworks deemed beautiful seem to share certain qualities. Foremost among these qualities are universality and economy; more specifically, the ability to explain the creation of complexity from simplicity. In physics for instance, the Dirac equation is considered a supreme example of beauty since in half a dozen symbols it essentially explains all the properties of the electron and also unifies it with the special theory of relativity. In mathematics, a proof ? Euclid?s proof of the infinitude of prime numbers for instance ? is thought to be beautiful if it combines the qualities of economy, generality and surprise. Beauty is inherent in biology too. Darwin?s theory of natural selection is considered to be especially elegant because just like equations in physics or theorems in mathematics, it explains an extraordinary diversity of phenomena using a principle which can be stated in a few simple words.

It is not easy to find similar notions of beauty in chemistry, but if we look around carefully we do find examples, even if they may not sound as profound or universal as those in chemistry?s sister disciplines. Perhaps the epitome of beauty in chemistry is the science and art of synthesis, an activity that is at the heart of chemical science and which is largely responsible for the making of the modern material world. Nobody embodies this art form better than the American organic chemist Robert Burns Woodward. During his lifetime Woodward honed chemical synthesis ? the painstaking, step-by-step construction of complex, three-dimensional molecules ? to the status of an activity very much akin to immortal architecture or painting. He made molecules ? strychnine, reserpine, chlorophyll, vitamin B12 ? whose synthesis defied belief; the Nobel Committee compared him to Nature herself when awarding him their prize. The atom-by-atom creation of these structures combined the breathtaking elegance of Chartes Cathedral with the practical economy of the San Francisco Bay Bridge. Today synthesis has been so finely perfected that much of it has become a routine task for graduate students, but the wealth of molecular structures and the sheer variety of their atomic decorations is still overwhelming.

In addition synthesis ? both in the test tube and in nature ? presents to us the atomic equivalent of ballet, the elegant motion of electrons from one bond and atom to another that is the bane of many a college student during finals week. What makes this elegance particularly beguiling is that it?s largely fiction; in reality molecules are a collection of nuclei and electrons and no more, and any kind of bonding and electron transfer scheme that we may use to represent their behavior is an elaborate facade crafted on paper for the sake of significance. Nonetheless, the molecular ballet that chemists are familiar with plays out daily both in their flasks and in our bodies where enzymes orchestrate incredible feats of chemical transformations with near-perfect efficiency.

But if we are to truly compare chemistry to physics or mathematics we might focus on more conceptual advances. Many of these examples are most manifest in theories of chemical bonding, since these theories underlie all of chemistry in principle. I certainly saw elegance when I studied crystal field theory. Crystal field theory uses a few simple notions of the splitting of energies of molecular orbitals to explain the color, magnetic and electric properties of thousands of compounds; it will tell you why rubies are red and emeralds are green. Crystal Field Theory is not a quantitative framework and it?s not perfect, but it can be taught to a high school student and has ample qualitative explanatory power. Another minor chemical concept which impressed me with its sheer simplicity was VSEPR (Valence Shell Electron Pair Repulsion). VSEPR predicts the shape of simple molecules based on the number of their valence electrons. Working out the consequences for a molecule?s geometry using VSEPR is literally a back of the envelope exercise. It?s the kind of idea one may call ?cute?, but in its own limited way it?s certainly elegant. Yet another paradigm from the field of bonding is H?ckel theory. H?ckel theory seeks to predict the orbital energies and properties of unsaturated molecules like ethylene and benzene. It will tell you for instance why tomatoes are red and what happens when a photon of light strikes your retina. Again, the theory is not as rigorous as some of the advanced methods that followed it, but for its simplicity it is both elegant and remarkable useful.

As an aside, anyone who wants to get an idea of beauty in chemistry should read Linus Pauling?s landmark book ?The Nature of the Chemical Bond?. The volume still stands as the ultimate example of how an untold variety of phenomena and molecular structures can be understood through the application of a few simple, elegant rules. The rules are derived through a combination of empirical data and rigorous quantum mechanics calculations. This fact may immediately lead purist physicists to denounce any inkling of beauty in chemistry, but they would be wrong. Chemistry is not applied physics, and its unique mix of empiricism and theory constitutes its own set of explanatory fundamental principles, in every way as foundational as the Dirac equation or Einstein?s field equations are to physics.

This mention of the difference between empiricism and theory reminds me of a conversation I once had with a colleague that bears on our discussion of elegance and beauty in chemistry. We were arguing about the merits of using molecular mechanics and quantum mechanics for calculating the properties of molecules. Molecular mechanics is a simple method that can give accurate results when parameterized using empirical experimental information. Quantum mechanics is a complicated method that gives rigorous, first-principle results without needing any parameterization. The question was, is quantum mechanics or molecular mechanics more ?elegant?? Quantum mechanics does calculate everything from scratch and in principle is a perfect theory of chemistry, but for a truly rigorous and accurate calculation of a realistic molecular system, its equations can become complicated, unwieldy and can take up several pages. Molecular mechanics on the other hand can be represented using a few simple mathematical terms which can be scribbled on the back of a cocktail napkin. Unlike quantum mechanics, molecular mechanics calculations on well-parameterized molecules take a few minutes and can give results comparable in accuracy to those of its more rigorous counterpart. The method needs to be extensively parameterized of course, but one could argue that its simple representation makes it more ?elegant? than quantum mechanics. In addition, on a practical basis one may not even need the accuracy of quantum mechanics for their research. Depending on the context and need, different degrees of accuracy may be sufficient for the chemical practitioner; for instance, calculation of relative energies may not be affected by a constant error in each of the calculations, but that of absolute energy will not tolerate such an error. The discussion makes it clear than, while definitions of elegance are beyond a point subjective and philosophical, in chemistry elegance can be defined as much by practical accessibility and convenience as by perfect theoretical frameworks and extreme rigor. In chemistry ?truth? can be tantamount to ?utility?. In this sense the chemist is akin to the carpenter who judges the ?truth? of his chair based on whether someone can comfortably sit on it.

While these expositions of beauty in theories of chemical bonding are abstract, there is a much starker and obvious manifestation of chemical pulchritude, in the marvelous little molecular machines that nature has exquisitely crafted through evolution. This is true of crystal structures in general but especially of protein structures. X-ray crystallographers who have cracked open the secrets of key proteins are all too aware of this beauty. Consider almost any structure of a protein deposited in the Protein Data Bank (PDB) ? the world?s largest protein structure repository ? and one immediately becomes aware of the sheer variety and awe-inspiring spatial disposition of nature?s building blocks. As someone who looks at protein and ligand structures for a living, I could spend days staring at the regularity and precise architecture of these entities. The structure of a profoundly important biochemical object like the ribosome is certainly pleasing to the eye, but more importantly, it contains very few superfluous elements and is composed of exactly the right number of constituent parts necessary for it to carry out its function. It is like a Mozart opera, containing only that which is necessary. In addition these structures often display elements of symmetry, always an important criterion for considerations of beauty in any field. Thus an elegant molecular structure in general and protein structure in particular straddles both the mathematician?s and biologist?s conception of beauty; it is a resounding example of economy and it resembles the biologist?s idea of geometric harmony as found in creatures like crustaceans and diatoms.

The ensuing discussion may make it sound like chemistry lacks the pervasive beauty of grand explanatory theories and must relegate itself to limited displays of elegance and beauty through specific models. But chemistry also has trappings of beauty which have no counterpart in physics, mathematics or biology. This is most manifest through the drawing of molecular structures which are an inseparable part of the chemist?s everyday trade. These displays of penmanship put chemistry in the same league as the visual arts and architecture and impart to it a unique element of art which almost no other science can claim. They constitute acts of creation and not just appreciation of existing phenomena. What other kind of scientist spends most of his working day observing and manipulating lines, circles, polygons and their intersections? A Robert Burns Woodward who could fill up a whole blackboard with stunningly beautiful colored handrawn structures and make this chemical canvas the primary focus of his three-hour talk can exist only in chemistry.

While contemplating these elegant structures, our original question arises again: is the beauty in these drawings the truth? What is worth reiterating in this case is that almost all the structures that chemists draw are purely convenient fictions! Consider the quintessential prototype aromatic hydrocarbon, benzene, drawn with its alternating double bonds. In reality there are no double bonds, not even dotted lines representing partial double bonds. The same goes for every other molecule that we draw on paper in which one-dimensional geometric representations completely fail to live up to the task of corresponding to real entities. Like almost everything else in chemistry, these are models. And yet, think about how stupendously useful these models are. They have made their way into the textbooks of every ambitious student of chemistry and constitute the principal tools whereby chemists around the world turn the chaff of raw materials like hydrocarbons from crude oil into the gold of immensely useful products like pharmaceuticals, plastics and catalysts. The great physicist Eugene Wigner once wrote an influential article titled ?The Unreasonable Effectiveness of Mathematics in the Natural Sciences?. Wigner was expressing awe at the uncanny correspondence between artificial squiggles of mathematical symbols on paper and the real fundamental building blocks of the natural world like elementary particles. Chemists need to express similar awe at the correspondence between their arrow pushing, molecular chairs and boats and the manifestation of these manipulations as the real solids, liquids and gases in their beakers. One kind of arrow pushing leads to the creation of a cancer drug, another kind leads to a better catalyst for petroleum refining. In this instance, the beauty of molecular structures quite spectacularly corresponds to the truth.

Finally, are their cases where chemists have to sacrifice truth for beauty just like Weyl did? Unlike mathematics and physics where equations can be unusually powerful in explaining the world, such a sacrifice would probably be far more wasteful and risky in the messy world of chemistry. In his Cope Lecture, Woodward said it best when he acknowledged the special challenge of chemistry compared to mathematics:

?While in mathematics, presumably one?s imagination may run riot without limit, in chemistry, one?s ideas, however beautiful, logical, elegant, imaginative they may be in their own right, are simply without value unless they are actually applicable to the one physical environment we have- in short, they are only good if they work! I personally very much enjoy the very special challenge which this physical restraint on fantasy presents.?

The ?physical restraint on fantasy? that Woodward talked about keeps every chemist from being seduced by beauty at the expense of truth. Beauty still reigns and is a guiding force for the chemist whenever he or she plans a synthesis, solves an x-ray structure, computes a molecular property or mixes together two simple chemicals with the expectation that they will form a wondrous, intricate lattice. But unlike Keats, the chemist knows that truth can be beauty but beauty may not be truth. As Woodward quipped, ?In chemistry, ideas have to answer to reality?. And reality tends to define beauty in its own terms.

Watch Pope John Paul II take BP! (video)

If there?s one thing we know about the late Pope John Paul II, it?s that he was a contact hitter in the purest sense ? willing to move the runners along at the expense of his own statistics. That?s what being Pope is all about, my son. Also if he stole second base, he would immediately feel guilty and return to first.

He is also reputed to have had a sweet swing, and when he hit the ball it was as if the sphere was guided to the heavens by a choir of angels. Unfortunately there is no video record of this ? until now. The video below is supposedly Pope John Paul II taking batting practice during a visit to California in 1987. The video was ?released by the Vatican? in 2006, according to the YouTube description, and for some reason is making the rounds now. Why would the Bishop of Rome, the most important man in the Catholic faith whom millions rely on for spiritual guidance, risk a holy beaning? He wouldn?t: this video is most assuredly a fake. Good likeness, though.

The Pope did, in fact, visit California in 1987, and even performed mass at Candlestick Park and at Dodger Stadium. But I doubt that he grabbed a glove and ran to the outfield to shag flies. I also highly doubt that his itinerary allowed for a visit to a Grand Slam USA in Santa Cruz.
